THUNDER VALLEY DOBERMANS PUPPY CONTRACT
The puppy you have selected is warranted by Bonnie Brochtrup to the original purchaser. This puppy appears to be of sound body, and in good health, as far as appears to the eye at the time of purchase. This puppy is warranted for the period of 1 year against hereditary and congenital disorders that will interfere with this puppies ability to lead a normal life. Should a veterinarian find a hereditary or congenital disorder within 1 year of purchase, you must supply us within 14 days of diagnosis, your veterinarians written report. We reserve the right to have any diagnosis verified by a veterinarian of our choice. The puppy would then be replaced with another puppy of equal value, and as available. Puppies are NOT sold on a trial basis! If said puppy/dog does not work out, he/she must be returned to us at buyers expense. If puppy/dog is returned no refund will be given. At NO time should a puppy/dog be placed in any rescue organization, shelter, pound or any other such organization and/or for any reason. If a situation such as this ever presents itself, you simply are agreeing that you will return his/her to me.
HOUSING OF THE PUPPY/DOG
At no time will the puppy/dog sold in this contract be chained or tied in a yard! Exceptions to this rule are with Protection sport training, and in which case are allowed, but the age of the dog must exceed 10 months of age. And in protection training the dog must not be tied or chained any longer then 2 hours, and must be on a thick defense collar or working harness. Also puppy/dog are not to be left in an outdoor kennel in extreme heat or cold!! Puppy/dog are not to left outside unattended unless in a fenced yard or have an invisible fence.
BREEDING OF A THUNDER VALLEY PURCHASED PUPPY:
This puppy comes with LIMITED akc registration, unless stated otherwise by Bonnie Brochtrup. Which does entitle breeding rights.
EXCEPTIONS: No Bitch shall be bred before the age of 19 months!! To breed a bitch under this age is in direct violation of this contract and if this were to be confirmed would result in a penalty of immediate forfeit of the bitch., and the bitch would immediately be returned to Bonnie Brochtrup at the owners expense.
No male dog shall be bred before the age of one year. To use a stud before the age of 12 months is in violation of this contract and therefore if there were findings of use of a stud before 12 months of age, will result in a forfeit and confiscation of the dog at which time and be returned to Bonnie Brochtrup at the owners expense.
NEVER will the said puppy/dog be bred to or by a Z FACTORED DOBERMAN(any Doberman which is registration begins as WZ) If said dog was to be bred to, or by a Z factored Doberman. This is in direct contradiction to this contract would result in immediate forfeit and confiscation of the dog upon finding of such actions. And also a fee of $5,000.00, shall be paid to Bonnie Brochtrup, for damages to the reputation of Thunder Valley Dobermans/ Bonnie Brochtrup, from breeding to a Z factor Doberman, against the contract of Thunder Valley Dobermans and Bonnie Brochtrup. Also at no time is the said dog to be bred to an VWD AFFECTED Doberman.
The said dog in this contract will be tested for Hip Displacia through OFA or Penn hip before breeding. Also the said dog will be tested for VWD by vetgen laboratory before mating (unless the dog is from a vwd clear by parentage litter, in which case copies of the sire and dam of the pups vetgen results will be provided by Bonnie Brochtrup and accompany the pup at the time of sale). If the said dog is bred before the 24 months of age that is required by OFA in order to certify hips. Then a preliminary x-ray must be sent to Bonnie Brochtrup.
Results of either preliminary x-ray, OFA or penn hip and Vetgen VWD status must be sent to Bonnie Brochtrup before the litter is whelped. These 2 test are a minimum breed standard and represent ethical breeding practices. If the owner is to choose not perform these 2 tests and not provide the results to Bonnie Brochtrup before mating said dog, there will be a penalty of $2500 to the owner of the dog for violation of the terms of this written contract and damage to the reputation of Thunder Valley Dobermans and Bonnie Brochtrup.
Any costs assessed in gaining proof of any violations of this contract will be added at the time of legal action.
Bonnie Brochtrup will honor the Thunder Valley Dobermans health guarantee to those in which it has been issued, if there were ever a need to claim the health guarantee to replace a puppy, a copy of the Guarantee must be presented with the date of issue and the signature of Bonnie Brochtrup.
I,___________________________________________ by signing this contract have read and understand the terms and conditions within this contract. I also agree that if I am in violation of any part of this contract I am subject to a $5000 penalty and forfeit the rights to above said pup/dog and must return him or her to Bonnie Brochtrup at my expense. I understand this contract is to protect the reputation and integrity of Bonnie Brochtrup and the Thunder Valley Dobermans breeding program. I fully understand this contract and agree to all terms and statements within. GOVERNING LAW: This agreement shall be governed by and construed in accordance with the laws of the state of WI.
